Terms of Sale

These General Terms and Conditions of Sale (“Terms of Sale”) govern sales made by FlowFlow France SAS on the website flowflowfrance.com (the “Site”) to consumers acting for non-professional purposes.

Any Order implies full and complete acceptance of these Terms of Sale.

Article 1 — Definitions

  • Customer: any adult individual with legal capacity who purchases a Product on the Site for non-professional purposes.
  • Order: the process by which the Customer selects one or more Products, adds them to the cart and confirms their purchase on the Site.
  • Product: any product offered for sale by FlowFlow on the Site.
  • Site: the website flowflowfrance.com, published by FlowFlow France SAS.

Article 2 — Purpose and Acceptance

These Terms of Sale define the conditions under which FlowFlow sells its Products to Customers through the Site.

They are available on the Site at all times. Confirming an Order constitutes unconditional acceptance of these Terms of Sale.

Article 3 — Products

The Products offered for sale are those presented on the Site.

Their essential characteristics, functions and, where applicable, precautions and conditions of use are set out on the corresponding product pages, in accordance with Article L.111-1 of the French Consumer Code.

Article 4 — Prices

Prices displayed on the Site are stated in euros and include all applicable taxes (VAT included).

Delivery charges are shown before final confirmation of the Order and, where applicable, are added to the price of the Products.

The applicable price is the price in force when the Order is confirmed. FlowFlow may change its prices at any time, without affecting Orders that have already been confirmed.

Article 5 — Orders and Formation of the Contract

Before confirming an Order, the Customer may review its contents and total price and correct any errors.

Final confirmation of the Order entails an obligation to pay and constitutes acceptance of these Terms of Sale.

An Order confirmation is sent to the Customer by email.

FlowFlow reserves the right to refuse or cancel an Order for legitimate reasons, including stock shortages, a manifest pricing error, suspected fraud or a previous payment-related dispute.

Where applicable, any amounts already received will be refunded to the Customer without undue delay.

Article 6 — Payment

Payment is made using the methods offered on the Site at the time of the Order, through secure payment solutions.

FlowFlow does not retain the Customer's full bank-card details when these are processed directly by its payment service providers.

Article 7 — Retention of Title and Transfer of Risk

FlowFlow retains ownership of the Products sold until their price has been paid in full.

The risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products.

Article 8 — Delivery

The applicable delivery areas, methods, timeframes and charges are specified on the Site before the Order is confirmed.

Detailed delivery terms, including the discreet-packaging commitment applicable to the relevant Products, are set out in the Site's “Shipping, Returns & Exchanges” policy.

Article 9 — Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has fourteen days from receipt of the Product to exercise the right of withdrawal, without having to give a reason.

The Customer may exercise this right using the withdrawal form available on the Site, the electronic withdrawal feature accessible on the Site, or any other unambiguous statement expressing the wish to withdraw.

The Customer then has fourteen days to return the Product.

The direct cost of returning the Product is borne by the Customer, unless FlowFlow states otherwise.

Detailed return and refund terms are set out in the Site's “Shipping, Returns & Exchanges” policy.

Article 10 — Hygiene Exception to the Right of Withdrawal

In accordance with Article L.221-28, 5° of the French Consumer Code, the right of withdrawal may not be exercised for products that have been unsealed after delivery and cannot be returned for reasons of health protection or hygiene.

For Products covered by this exception, it applies once the hygienic protective seal, or the seal on their direct hygienic packaging, has been opened, removed or damaged.

The Products concerned are identified as such on their product page.

This exception to the right of withdrawal does not affect the statutory guarantees applicable to defective or non-conforming Products.

Article 11 — Statutory Guarantees

Products sold by FlowFlow benefit from the applicable statutory guarantees, independently of any commercial warranty that may also apply.

The professional responsible for these guarantees is:

FlowFlow France SAS
2 rue de Verdun
78500 Sartrouville, France
Email: support@flowflowfrance.com
Telephone: 07 59 50 11 05

The Products benefit in particular from:

  • the statutory guarantee of conformity, under the conditions set out in Articles L.217-3 et seq. of the French Consumer Code;
  • the statutory guarantee against hidden defects, under the conditions set out in Articles 1641 et seq. of the French Civil Code.

The consumer has a period of two years from delivery of the goods to obtain implementation of the statutory guarantee of conformity where a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity, and not the date on which it appeared.

Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period longer than two years, the statutory guarantee applies to that digital content or digital service throughout the scheduled supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.

The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without significant inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair of the goods but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if:

1° The professional refuses to repair or replace the goods;

2° Repair or replacement of the goods takes place after a period of thirty days;

3° Repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer ultimately bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a reduction in the price of the goods or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights referred to above arise from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs implementation of the statutory guarantee of conformity may incur a civil fine of up to €300,000, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.

For any request relating to statutory guarantees, the Customer may contact FlowFlow at contact@flowflowfrance.com, stating the Order number and the nature of the defect identified.

Article 12 — Use of Products and Liability

Products must be used for their intended purpose and in accordance with their instructions, as well as any precautions for use and contraindications stated on the product page, packaging or instructions.

FlowFlow cannot be held liable for damage resulting from use of a Product that does not comply with these instructions, subject to any mandatory statutory provisions that apply.

Article 13 — Changes to the Terms of Sale

FlowFlow reserves the right to amend these Terms of Sale at any time, in particular to reflect legal, regulatory or technical developments.

The version applicable to an Order is the version in force on the Site on the date that Order is confirmed.

Article 14 — Governing Law and Mediation

These Terms of Sale are governed by French law.

In the event of a dispute, the Customer is invited to contact FlowFlow first at contact@flowflowfrance.com in order to seek an amicable solution.

If no amicable solution is reached, the Customer may refer the matter free of charge to the consumer mediator responsible for FlowFlow:

Mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice)
Postal address: 49 Rue de Ponthieu, 75008 Paris
